On January 24, 2024, the results of the “Top 10 Cases for Promoting the Rule of Law in the New Era in 2023″ jointly organized by the Supreme People’s Court and China Central Television were officially announced. The case of GESC v. Shandong Hualu Hengsheng Chemical Co., Ltd. involving “melamine” invention patents and technical secrets was selected as one of the top 10 cases of the year.
The selection activity was launched on December 24, 2023, and 45 typical cases were selected from the 2023 concluded cases in the national courts. After being voted by netizens and selected by experts, the Golden Elephant patent and technology secret case involving “melamine” stood out and was successfully selected due to its typical significance and exemplary leading role.
Wang Yi, Vice President of Renmin University of China and Executive Vice President and Secretary General of the Civil Law Research Association of the China Law Society, believes that this case is currently the highest amount of compensation awarded by the people’s court for intellectual property infringement related to the same engineering project. It fully reflects the new era’s judicial concept of strengthening intellectual property protection with strong protection, effective protection, and equal protection.
